Privacy Statement for Kingston Data & Credit International Inc.

This Privacy Statement is designed to tell you about the practices of Kingston Data & Credit International Inc. (also referred to as “KDCII” “Us,” or “We”) with respect to the collection, use, and disclosure of information about you that we receive through our website located at kdcii.com (the “Site”), including your use of our payment portal (the “Portal”) made available through the Site.  This Privacy Statement only addresses information collected directly through or from the Site – it does not address or govern any information-gathering, use, or dissemination practices related to information collected from a visitor (sometimes referred to as "you" or "your") other than directly through or from the Site, such as from telephone, sms message, facsimile, postal mail, personal delivery, or other or additional offline means or media.

This Privacy Statement is incorporated into KDCII’s Terms and Conditions for the Site by reference, as if set forth fully therein. By using the Site, you expressly consent and agree to the Terms and Conditions and this Privacy Statement.

1. General Principles

KDCII’s services are intended for U.S. customers.

Our services are not intended for people under the age of 18.  We do not knowingly collect information from under 18 years of age without parental consent.

If you have a financial product or service with us, we share information we collect from or about you in accordance with our Customer Privacy Notice. If there are any conflicts between the terms of this Privacy Statement and the terms of our Customer Privacy Notice, the terms of the Customer Privacy Notice will control.

2. What is Personal Information?

If information can be used to identify you as an individual, we treat this information as “Personal Information.”  If we combine non-identifiable information with Personal Information, we treat the combined information as Personal Information.

3. Collection of Personal Information

 What you give us:  We collect the information that you provide to us when you interact with the Site.  For example, when you provide additional information, such as mobile telephone number, driver’s license number, bank account, or credit card information.

From the original creditor: We may receive Personal Information about you from the original creditor, such as account balance, payment history, and account activity.

From credit reporting agencies and other vendors:  We may receive information from credit reporting agencies, such as credit scores and history, employment history, and other information related to your credit.

Public records:  We may obtain access to public records, such as court filings, property ownership, or tax data.

Automatically collected information: We also collect certain information through automated means.  Some of the information we collected through automated means may, whether alone or combined with other data, be Personal Information.  You can learn more about this in the Section called “Passive Information Collection Uses and Choices” below.

4. Use of Personal Information Collected

We may use Personal Information to collect the amounts owed pursuant to your payment plan, to service and manage your accounts, to validate or verify the existence of any dispute involving payment, and to respond to your inquiries or requests.

We may also use Personal Information as we believe to be necessary or appropriate: (a) under applicable law; (b) to comply with legal process; (c) to respond to requests from public and government authorities, including public and government authorities outside your country of residence; (d) to enforce our terms and conditions; (e) to protect our operations or those of any of our affiliates; (f) to protect our rights, privacy, safety or property, and/or that of our affiliates, you, or others; and (g) to allow us to pursue available remedies or limit the damages that we may sustain.

We may also use Personal Information that we collect to improve the Site and the Portal, and for our analyses.  We may remove the elements of your Personal Information that could identify you.  We may use and disclose the resulting “de-identified” information without restrictions.  For example, KDCII may create de-identified, statistical, and aggregate data to prepare reports about the Site, including the Portal, that do not identify individual users.

Where permitted by applicable law, we may use Personal Information to promote our products and services, and the products and services of our affiliates.  If you are a customer of KDCII with a financial product or service, you may prevent the sharing of certain Personal Information with our affiliates for marketing their products or services as described below under “Opting Out of Information Sharing.”

You may opt-out or opt-in to receive e-mails, SMS text messages, and telephone notifications from us.  Email or telephone communications and text messages will be sent to the email address and/or mobile telephone number that you provide through the Portal.

Finally, we may use Personal Information in additional ways when we receive your express consent

5. Disclosure of Personal Information

Personal Information may be shared with the following parties for the purposes described below:

With the original creditor for purposes of collecting a debt; with our affiliates, vendors, and contractors who assist us in managing, administering or delivering our products and services and the Portal, including mailing services and collection-related services. We will require such parties to use and protect the information about you according to this Privacy Statement and other requirements that we place upon them by contract; to third parties, such as a financial institution or credit bureau, to validate or verify the existence of any dispute involving payment; with others when you expressly direct us to share information about you; with affiliated and non-affiliated parties if not prohibited by the federal Fair Debt Collection Practices Act or by other applicable laws.  See the section below called “Opting Out of Information Sharing” for more information; in connection with the sale, assignment, or other transfer of some or all of the assets of our business, we may transfer the information about you, in which case we will require any such buyer or acquiring party to agree to treat the information in accordance with this Privacy Statement; and / or to respond to law enforcement requests or where required by applicable laws, court orders, or government regulations.

We will not sell or otherwise give Personal Information about you to non-affiliated third parties for their marketing purposes.

6. Passive Information Collection, Use, and Choices

As you navigate the Site, certain information relating to you, your computer or your device, may be passively collected, meaning it is gathered without your actively providing it. This is done using the following technologies in the following ways:

i. Through your browser:
Certain information is collected by most browsers, such as your Media Access Control (MAC) address, computer type and operating system type and version screen resolution, and Internet browser type and version.

ii. Through your device: If you access the Site through a mobile device or other network-connected product, certain information may be collected about that device, including your device type, network service provider, and other identifiers. We may collect unique device identifiers (such as IDFA and AID tags and UUID and UDID identifiers) associated with the device you use to access the Site.

iii. Using cookies: Cookies are pieces of information stored directly on the computer you are using. Cookies allow us to collect information such as browser type, time spent on the Site, pages visited, and language preferences. We and our service providers use this information for security purposes, to facilitate navigation, display information more effectively, and to personalize your experience while using the Site. More specifically, we use cookies to:

  • recognize your computer or device to make your use of the Site easier, such as to remember your locations of interest and other preferences with the Site;
  • gather statistical information about use of the Site in order to continually improve its design and functionality, understand how individuals use it, and to assist us with resolving questions regarding it;
  • select which offers are most likely to appeal to you and display them while you are on the Site;
  • track consumer responses to online advertisements.

iv. Using Monitoring Tools: The Site may utilize pixel tags, web beacons, clear GIFs ,Flash Shared Objects, HTML5 Local Storage, HTML5 Mini Databases, and other similar technologies, both on certain aspects of the Site and in HTML-formatted e-mail messages to you. These monitoring tools are used for the purpose of, among other things, measuring the success of our marketing campaigns, compiling statistics about Site usage and response rates, and tracking the activities of users of the Site and e-mail recipients.

v. IP Address: Your IP Address is a number that is automatically assigned to the computer that you are using by your Internet Service Provider. An IP Address is identified and logged automatically in our server log files whenever a user visits the Site, along with the time of the visit and the page(s) that were visited. Collecting IP Addresses is standard practice on the Internet and is done automatically by many online service providers, including website operators. We use IP Addresses for purposes such as calculating Site usage levels, helping diagnose server problems, and administering the Site.

vi. Analytic Tools: We also use tools and third party services to collect information about usage of the Site, including Google Analytics. Generally speaking, Google Analytics collects information on how often users visit the Site, what aspects of the Site they visit when they do so, and what other websites users visited prior to accessing the Site. You may prevent your data from being collected and used by Google Analytics by opting out through the use of the Google Analytics Opt-out Browser Add-on.

vii. Location-Based Features: We may use information about your location to conduct analytics and improve the Site and to provide certain location-based services, as further described in this Privacy Statement and as otherwise described to you at the point of collection. To provide these location-based features, in addition to the information that you voluntarily submit through the Site, we may also access information about your approximate location using automated means, such as using your cell ID.

If you are uncomfortable with the idea of information related to you being collected and used in these ways, most computer systems, devices, and web browsers offer privacy settings and options, such as disabling cookies, resetting your IDFA, turning off location-based services, or opting for “Do Not Track” features. We do not override these settings or options and encourage you to use them to enhance your choices and personalize your experiences. However, in order to access certain content, features, services, products, or benefits of the Site, including the Portal, you may be required to provide us with certain information. If you do not wish to provide that information through the Site, or if you opt to utilize the aforementioned privacy features, you may be unable to obtain certain content, features, services, products, or benefits of the Site.

7. Security Measures

We take reasonable steps to protect information about you in our possession and control, such as for information associated with the Portal, and to protect such information from loss, misuse, and unauthorized access, disclosure, alteration, or destruction. You should keep in mind that no Internet transmission is ever completely secure or error-free. In particular, e-mail sent between you and us may not be secure.

9. Opting Out of Information Sharing

If you would prefer not to receive marketing materials from KDCII’s affiliates about their products or services, you can opt out of such affiliate marketing by either (1) calling Kingston Data & Credit International at 888-908-7743, or (2) visiting kdcii.com and downloading, completing, and returning the applicable Affiliate Marketing Opt-Out Form to Kingston Data & Credit International Inc at the address listed on the form.  If you opt-out and later change your mind, please let us know and we will change your choice.  Your opt-out does not prevent us from sending information about products or services offered by KDCII or our affiliates.  Similarly, your opt-out does not prevent a KDCII affiliate from using certain Personal Information received from KDCII to market the affiliate’s products and services to you if (a) you have a pre-existing relationship with such affiliate, or (b) you contact such affiliate directly and request information regarding such affiliate’s products or services. 10. Right to Change Privacy Statement 

KDCII reserves the right at any time to modify, alter or update this Privacy Statement. Your use of the Site following any changes means that you agree to follow and be bound by the Privacy Statement as changed. Any change to this Privacy Statement shall be effective as to any visitor who has visited the Site before the change was made. It is the obligation of users visiting the Site before the change to learn of changes to the Privacy Statement since their last visit

     WE ARE REQUIRED BY LAW TO GIVE YOU THE FOLLOWING INFORMATION ABOUT THIS DEBT:  The legal time limit (statute of limitations) for suing you to collect this debt expires after six years from the date the debt became due.  However, if someone sues you outside of this period to try to make you pay this debt, the court rules REQUIRE YOU to tell the court that the statute of limitations has expired to prevent the creditor from obtaining a judgment.  Even though the statute of limitations may have expired, you may choose to make payments.  However, be aware that if you make a payment, the creditor’s right to sue you and the statue of limitations may start again.
